TERMS AND CONDITIONS

These JOBNUR Terms and Conditions of Use (“JOB NUR Terms and Conditions”) govern the access or use by you, an individual, and/or a company, of the services including applications, websites, content etc. through any electronic device or otherwise, as the case may be (the “JOB NUR Services” or “Services”) made available by JOBNUR PRIVATE LIMITED, a company incorporated under the Companies Ordinance, 1984. (hereinafter referred to as the “JOB NUR” or “us” or “Company” which expression shall, unless inconsistent with the context or meaning thereof, be deemed to include its successors and assigns).

Important – please read these terms carefully. In order to use most aspects of the JOBNUR Services, you must register for and maintain an active personal user JOBNUR Services account (the “Account”). You must be at least 18 years of age or such age of legal majority as may be prescribed under the law from time to time, to obtain an Account. Account registration requires you to submit to JOBNUR certain personal information, such as your name, address, mobile phone number and age. You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access and use the JOB Services or JOB NUR’s termination of these JOBNUR Terms and Conditions with you. You are responsible for all activity that occurs under your Account and JOBNUR Wallet (defined below), and you agree to maintain the security and secrecy of your Account and JOBNUR Wallet username and password at all times. Unless otherwise permitted by JOBNUR in writing, you may only possess only one Account. The JOBNUR Services is not available for use by persons who have not attained age of legal majority as prescribed under the applicable law. You may not authorize third parties to use your Account or JOBNUR Wallet, and you may not allow persons who are under the legal age of majority prescribed under the applicable law to receive services from Third Party Service Providers unless they are accompanied by you. You may not assign or otherwise transfer your Account or JOBNUR Wallet to any other person or entity. You agree to comply with all applicable laws when using the JOBNUR Services and you may only use the JOBNUR Services for lawful purposes (e.g. not for service of unlawful or hazardous materials). You will not, in your use of the JOBNUR Services, cause nuisance, annoyance, inconvenience, or property damage, whether to the Third-Party Provider or any other party. In certain instances, you may be asked to provide proof of identity to access or use the JOBNUR Services, and you agree that you may be denied access to or use of the JOBNUR Services if you refuse to provide proof of identity. Your access and use of the JOBNUR Services constitutes your agreement to accept and be bound by these JOBNUR Terms and Conditions, which establishes a contractual relationship between you and JOBNUR. If you do not agree to these JOBNUR Terms and Conditions, you may not access or use the JOBNUR Services. These JOBNUR Terms and Conditions expressly supersede prior agreements or arrangements with you. JOBNUR may immediately terminate these JOBNUR Terms and Conditions or any JOBNUR Services with respect to you, or generally cease offering or deny access to the JOBNUR Services or any portion thereof, at any time for any reason whatsoever.
  1. JOBNUR is a handyman booking service that allows users to request a handyman via a mobile app, through the web, call center, SMS or email. The JOBNUR Services constitute a technology platform that enables users of JOBNUR to arrange and schedule Repair & Maintenance services with independent third-party providers of such services, including dependent third-party service providers under agreement with JOBNUR or certain of JOB NUR’s affiliates (the “Third Party Service Providers” or “Service Providers”).
  2. The Application allows you to send a request for a Service to a Service Provider. The GPS receiver - which should be installed on the mobile device (smart phone) on which you have downloaded the Application - detects your location and sends your location information to the relevant Service Provider. If you use any other form of vehicle booking request, Phone, SMS, email or web, the information provided by you on your location coordinates is used by JOBNUR to relay your request to the Service Provider, who has sole and complete discretion to accept or reject each of your requests for the Services. The Service Provider also has sole and complete discretion over whether to use the Application to receive the leads generated through the Application. If the Service Provider accepts your request, the Application notifies you and provides information regarding the Service Provider - including his/her name, customer service rating - and the ability to contact the Service Provider by telephone. The Application also allows you to view the Service Provider's progress towards the pick-up point, in real time and QR coded smart ID card to verify the Tasker.
  3. We will make every reasonable effort to bring you into contact with a Service Provider in order to obtain the Services, subject to the availability of Service Providers in or around your location at the moment of your request for Services.
  4. FOR THE AVOIDANCE OF DOUBT, WE ARE A TECHNOLOGY COMPANY, NOT A HANDYMAN COMPANY AND WE DO NOT PROVIDE REPAIRING/MAINTAINING MATERIAL & LOGISTICS OR DISPATCH LOGISTICS SERVICES BUT WE HAVE TRUSTED STORES. We do not employ the Service Providers and we are not responsible for any acts and/or omissions of the Service Providers. The Application is simply a means to ease the search of the Services. It is up to the Service Providers to offer the Services to you and it is up to you whether to accept their offers of Services. JOBNUR will only be offering the Application and JOBNUR Services as a platform to put users and Service Providers in touch with each other for acquisition of the services by the users from the Service Providers through the JOBNUR Services and Application, and JOBNUR will not be a participant in the transaction between the Service Providers and Users; each such transaction will be a bi partite contract solely between them. Accordingly, you acknowledge and agree that JOBNUR is not the agent of and has no authority for either the Service Providers or the users for any purpose.
  5. Only you may use your own Account and you undertake not to authorize others to use your identity or account. You may not assign or otherwise transfer your Account to any other parties. You must keep your Account password / pin code and any identification we provide you secure and confidential. In the event a disclosure is made to your pin code / passwords, howsoever, which causes any illegitimate or unauthorized uses of your Account or identity, orders generated from the illegitimate or unauthorized uses will still be deemed valid orders, unless you notify us on that matter before the Service Providers perform the requested Services.
  6. You may only have one JOBNUR Account and JOBNUR Wallet.
    1. JOBNUR Credit is your fund that can only be used for the payment of the services provided by the Service Provider and the fee of the Service Provider.
    2. If you are also a Service Provider, you may not use your (or other's) customer account to make a service that you will take yourself as a handyman.
  7. You may not harm, tweak or modify the Application and/or Website or attempt to harm, tweak or modify it in any way whatsoever. We are not liable if you do not have a compatible device or if you have downloaded the wrong version of the Application to your device. We reserve the right to prohibit you from further using the Application should you use the Application with an incompatible or unauthorized device or for purposes other than those for which the Application is intended to be used. You undertake that you will only use an access point you are authorized to use.
  8. You will keep confidential and will not abuse the information you receive from using the Application. You will treat the Service Providers with respect and will not engage in any unlawful, threatening or harassing behavior or activities whilst using their services.
  9. We and/or the relevant Service Provider reserves the right to refuse servicing in your area if confronted uncertain condition.
  10. Please inform us if you no longer have control of your account, e.g. your account is somehow hacked or your phone is stolen, so that we can cancel your account accordingly. Please note that you are responsible for the use of your account and may be held liable even if it is abused by another person.
  11. Customers are required to provide complete information regarding the type and specifications of the goods to be delivered.
  12. You will not use the Application and/or the Software to cause nuisance, annoyance, inconvenience or make fake bookings;
  13. You will not use the Services, Application and/or Software for purposes other than obtaining the Services.
  14. You will not copy, or distribute the Software or other content without written permission from the Company
  15. You will only use the Software and/or the Application for your own use and will not resell it to a third party.
  16. You will keep secure and confidential your Account pin code / password or any identification we provide you which allows access to the Services.
  17. You will provide us with whatever proof of identity we may reasonably request or require;
  18. You agree to provide accurate, current and complete information as required for the Services and undertake the responsibility to maintain and update your information in a timely manner to keep it accurate, current and complete at all times during the term of this Agreement. You agree that the Company may rely on your information as accurate, current and complete. You acknowledge that if your information is untrue, inaccurate, not current or incomplete in any respect, the Company has the right but not the obligation to terminate this Agreement and your use of the Services at any time with or without notice.
  19. You will only use an access point or data account (AP) which you are authorized to use;
  20. You shall not impair or circumvent the proper operation of the network which the Service operates on.
  21. You agree that your use of the Service will be subject to the Company’s Privacy Policy as may be amended from time to time.
  22. You agree that you will cooperate in relation to any financial crime screening that is required and to assist us in complying with any prevailing laws or regulations in place.
  23. You may terminate your account by informing us of your intention to cancel your account. We will try to do our best to complete the termination, including the return of your Credits (excluding the amount gained from referral or any other promotion) in 15 (fifteen) business days.
  24. We have the right to suspend the processing of any transaction where we reasonably believe that the transaction may be fraudulent, illegal or involves any criminal activity or where we reasonably believe you to be in breach of the Terms of Use.
  25. You are aware that when requesting transportation services by Call or SMS or use of the Service, standard telecommunication charges will apply.
  26. You agree that the Service is provided on a reasonable effort basis.
  27. You shall not employ any means to defraud the Company or enrich yourself, through any means, whether fraudulent or otherwise, through any event, promotion or campaign launched by the Company to encourage new subscription or usage of the Service by new or existing Passengers.
  28. Users are solely responsible for their job postings on JOB NUR’s application. JOBNUR is not to be considered to be an employer with respect to Your use of the application and JOBNUR shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs on JOB NUR’s application. By using the application or software, you agree that:
    1. You many not use any hyperlinks, other than those specifically authorized by JOBNUR.
    2. You may not use any misleading, unreadable, or "hidden" keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented, as determined in JOB NUR’s reasonable discretion.
    3. You many not post more than one job or job description, more than one location, or more than one job category, unless the product so allows.
    4. You may not post inaccurate, false, or misleading information; and material or links to material that exploits people in a sexual, violent or other manner, or solicits personal information from anyone under 18.
    5. You may not post jobs in a manner that does not comply with applicable local, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property.
    6. You may not post jobs that include any screening requirement or criterion in connection with a job posting where such requirement or criterion is not an actual and legal requirement of the posted job.
    7. You may not advertise sexual services or seek employees for jobs of a sexual nature.
    8. You may not request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy.
    9. You may not endorse a particular political party, political agenda, political position or issue; promote a particular religion; similarly not allowed to ask information of any handyman relating to his/her (i) racial or ethnic origin (ii) political beliefs (iii) philosophical or religious beliefs (iv) membership of a trade union (v) physical or mental health (vi) sexual life (vii) the commission of criminal offences or proceedings or (vii) age.
  29. JOBNUR reserves the right to remove any job posting or content from any user content listed on JOB NUR’s Services platform, which in the reasonable exercise of JOB NUR’s discretion, does not comply with the above Terms, or if any content is posted that JOBNUR believes is not in the best interest of JOBNUR.
  30. If at any time during Your use of JOBNUR Services, You made a misrepresentation of fact to JOBNUR or otherwise misled JOBNUR in regards to the nature of Your business activities, JOBNUR will have grounds to terminate Your use of JOB NUR’s Services.
  31. Any estimate which may be given either verbally or in writing by JOBNUR is subject to withdrawal by JOBNUR at any time before receipt of an unqualified acceptance from the Customer and shall be deemed to be withdrawn unless so accepted within one (1) hour from its time.
  32. Unless otherwise specified by JOBNUR in the relevant estimate, an estimate is not a firm or fixed price quotation. It is an estimate of the likely minimum cost of the Works, based on the information made available to JOBNUR. JOB NUR’s final price will be calculated on the basis specified in the estimate, if any, or if none, in accordance with JOB NUR’s Schedule of Rates applicable at the time the Works are carried out and may be increased above (but not reduced below) the specified price. Furthermore, JOBNUR reserves the right to increase the price before carrying out the Works by an amount equivalent to any increase to JOBNUR in the cost of relevant materials, labour, equipment hire or transport since the date upon which JOB NUR’s estimate, written, emailed or oral, was given, save that if this would increase the estimated price by more than 10%, the Customer may cancel the Service Contract provided it does so before the Works are begun, any relevant materials are ordered or any relevant equipment is hired.

Our Liabilities

  1. We are not liable for any injury, death, damage or loss caused by the conduct of the Service Providers. We are also not liable for any wrongdoings, including any criminal actions conducted by the Service Providers during the performance of the Services. The Service Providers are only our working partners, not our employees, agents or representatives.
  2. We employ appropriate and reasonable technical and security measures to keep the Application secure and virus and error free. However, as effective as this technology is, no security system is impenetrable. We therefore cannot guarantee the security of our database nor can we guarantee that the information you provide will not be intercepted while being transmitted to us.
  3. The Application may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications including the device used by you or the Service Provider being faulty, not connected, out of range, switched off or not functioning. We are not responsible for any delays, service failures, damages or losses resulting from such problems.
  4. The quality of the Service obtained through the use of the Application is entirely the responsibility of the Service Provider who ultimately provides the Service to you. You understand, therefore, that by using the Application, you may be exposed to worksite area that is potentially dangerous, belligerent, harmful to minors, unsafe or otherwise objectionable, and that you use the service at your own risk.

Other Provisions

Choice of Law.

This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which the relevant Affiliate is incorporated, without giving effect to any conflict of law principles, except as may be otherwise provided in supplemental terms applicable to your region.

Claims of Copyright Infringement.

Claims of copyright infringement should be sent to JOBNUR at info@jobnur.com.

Notice.

JOBNUR may give notice by means of a general notice on the JOBNUR Platform, electronic mail to your email address in your Account, or by written communication sent to your address as set forth in your Account. You may give notice to JOBNUR by written communication to JOBNUR's email address at info@jobnur.com. If any provision of this Agreement is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of this Agreement but the legality, validity and enforceability of the other provisions in this Agreement shall not be affected. In that event, the parties shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of this Agreement. This Agreement constitutes the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter.
