TERMS AND CONDITIONS

1. Jobnur Platform and User Roles

The Jobnur Platform is an online marketplace that connects Customers and Taskers. Customers are individuals or businesses seeking short-term services (Tasks), while Taskers are businesses offering to perform these Tasks. Together, Customers and Taskers are referred to as Users.

Taskers as Independent Contractors

Taskers are independent business owners providing services under their own names or business names, not under Jobnur’s name. They use their own tools and supplies and set their own rates for Tasks. Taskers can maintain their own clientele, offer services through other platforms, and accept or reject Customer requests. Taskers are independent contractors of Customers, not Jobnur.

Tasker Qualifications and Customer Responsibility

Any references to a Tasker being licensed, credentialed, or having a certain “reliability rating” indicate only that they’ve met specific criteria. These descriptions are intended to help Customers make informed decisions about Tasker selection. However, they do not represent an endorsement, certification, or guarantee from Jobnur.

Customers are responsible for determining their Tasks and selecting or approving their Taskers. They should conduct their own research to ensure a Tasker has the necessary qualifications before booking a Task.

2. Services

Jobnur offers a platform to customers for booking real-time services, including but not limited to handyman services, landscaping, hairstyling, transportation, and various other jobs. The services are provided by independent service providers (“Providers”). Jobnur acts as an intermediary, facilitating real-time connections between users and Providers until the job is completed and payment is processed.

3. User Responsibilities

3.1 Account Registration

Users must provide accurate information during registration and are responsible for maintaining the confidentiality of their account information. Users are responsible for all activities that occur under their account.

3.2 Account Protection:

It’s your duty to safeguard your login information and account. You are accountable for all actions performed using your account, regardless of authorization. If you suspect unauthorized use, please inform Jobnur immediately.

3.3 Compliance

Users must comply with all applicable laws and regulations while using the platform. This includes but is not limited to local, state, and federal laws.

3.4 Conduct

Users must act respectfully and not engage in any harmful or disruptive behavior. Any form of harassment, abuse, or other inappropriate conduct is strictly prohibited.

3.5 Prohibited Activities

Users are prohibited from using the platform to:

  • Engage in fraudulent activities
  • Misuse the platform in any way
  • Violate any local, state, or federal laws
  • Misrepresent their identity or affiliation with any person or entity
  • Transmit harmful code or interfere with the platform’s functionality

3.6 Account Termination

Jobnur reserves the right to suspend or terminate your account at its discretion, especially in cases of severe breaches such as fraud, illegal activity, or harmful behavior on the platform.

3.7 Account Deletion

Users can delete their accounts at any time through the platform. However, Jobnur will retain operational data for purposes such as generating reports, audits, and legal compliance. This retained data will not be used for marketing purposes.

4. Booking and Payment

4.1 Service Requests

Users can request services through our platform. Providers may offer bids within a range of estimated costs. The user can select the most suitable bid based on cost, reviews, and other factors.

4.2 Payment Authorization

Upon selecting a Provider, a hold will be placed on the user’s credit card for an amount to cover potential cancellations. This amount will be clearly communicated to the user at the time of booking.

4.3 Final Payment

When the service is completed, the final cost will be authorized and charged. If the final cost differs from the initial estimate, the user will be informed and asked to approve the new amount before the final charge is made.

5. Fees, Payments & Cancellations

5.1 Fees & Payments

  • Task Fees and Charges: Customers are responsible for the agreed-upon Task fee, out-of-pocket expenses, tips, applicable taxes, and processing fees.
  • Jobnur Fees: Jobnur charges a platform fee for connecting Customers with real time Taskers, a trust and support fee, and may charge a cancellation fee.
  • Payment Processing: All payments must be made through Jobnur’s designated payment provider.
  • Fraud Protection: Jobnur employs fraud detection measures to protect Customers.
  • Tax Reporting: Jobnur may collect and report taxes on behalf of Taskers. Taskers are responsible for their own tax obligations.

5.2 Provider Cancellations

If a Provider cancels, the user will not be charged, and Jobnur will assist in finding an alternative Provider. Users will have the option to either accept the new Provider or cancel the service request without any charge.

5.3 Refunds

Refunds may be granted at Jobnur’s discretion in cases where services are not rendered as promised or in accordance with the cancellation policy outlined at the time of booking.

6. Provider Responsibilities

6.1 Licensing and Insurance

Providers must have the necessary licenses and insurance for the services they offer. Providers are required to comply with all legal and regulatory requirements related to their services.

6.2 Quality of Service

Providers are responsible for delivering services to a high standard. Jobnur encourages users to rate and review Providers based on their service quality.

6.3 Tasker Responsibilities

Providers must:

  • Provide services professionally and in accordance with platform guidelines
  • Fulfill bookings as agreed upon with customers
  • Maintain communication with customers and Jobnur support when necessary

6.4 Payment Processing

Providers will receive payments through Jobnur’s integrated third party payment system. Fees and payout schedules will be outlined during the onboarding process.

6.5 Performance Monitoring

Jobnur monitors Provider performance through customer reviews and other metrics. Poor performance may result in account suspension or termination.

6.6 Dispute Resolution

Jobnur provides mediation services to resolve disputes between Providers and customers. Both parties are encouraged to seek resolution through our support channels.

7. Liability

7.1 Limitation of Liability

Jobnur is not liable for any damages or losses arising from the use of our platform or services provided by Providers. This includes but is not limited to direct, indirect, incidental, and consequential damages.

7.2 Indemnification

7.3 Data Protection and Security

Jobnur takes the protection of personal and financial information seriously. We employ industry-standard security measures, including encryption, to protect sensitive data such as Social Security Numbers, credit card information, and dates of birth. However, users acknowledge that no system is completely secure, and by using Jobnur, they agree to hold Jobnur harmless for any unauthorized access to or use of their personal information, except in cases of gross negligence or willful misconduct by Jobnur.

Indemnification

Customers:

As a Customer, you are responsible for any legal issues or financial losses that may arise from your use of the Jobnur platform. This includes, but is not limited to, any violations of the terms of service, applicable laws, or the rights of others. You agree to defend and hold harmless Jobnur and its affiliates from any legal claims or damages arising from your activities on the platform.

Taskers:

As  a Tasker, you are solely responsible for any legal or financial consequences arising from your use of the Jobnur platform. This includes, but is not limited to:

  • Your participation in Tasks: This includes any issues related to your ability or inability to perform Tasks or receive payment, such as failing to complete a Task, providing poor-quality service, or disputing payment.
  • Your use of the Platform: This includes any issues related to your access to or interaction with the platform, such as violating the platform’s rules or using the platform in a way that is harmful or disruptive to other users.
  • Violations of the terms of service: This includes, but is not limited to, providing false information, canceling a Task without valid reasons, or harassing other users.
  • Violations of applicable laws: This includes, but is not limited to, copyright infringement, defamation, or fraud.
  • Violations of the rights of others: This includes, but is not limited to, violating the privacy of other users or infringing on their intellectual property rights.
  • User Generated Content and/or Feedback: This includes any content or feedback submitted by or about you or using your account on the platform, such as posting inappropriate or offensive content, or making false or misleading statements about other users.
  • Actions of Tasker Assistants: This includes any actions or omissions of any assistants you may have hired to help you with Tasks, such as if they cause damage to a Customer’s property or violate the terms of service.

You agree to defend and indemnify Jobnur and its affiliates from any legal claims or damages related to your activities on the platform.

7.4 Third-Party Liability

Jobnur is not responsible for any issues that may arise from the services of our third-party partners, such as payment processors, communication platforms, or other external services. If you encounter any problems with these services, please let us know and we will do our best to assist you. However, please note that we may not be able to resolve issues directly related to the third-party services themselves.

8. Dispute Resolution

8.1 Mediation

Jobnur encourages users and Providers to resolve disputes amicably and may facilitate mediation if necessary. Jobnur may provide resources and support to help resolve disputes.

8.2 Binding Arbitration

Any unresolved disputes will be subject to binding arbitration. This means that the dispute will be resolved by an arbitrator rather than in court, and the arbitrator’s decision will be final and binding.

9. Changes to Terms

Jobnur reserves the right to update these terms at any time. Changes will be effective upon posting on our website. Continued use of our platform constitutes acceptance of the revised terms. Users are encouraged to review the terms regularly to stay informed of any changes.

10. Platform Use

10.1 Access and Use

Jobnur grants users a limited, non-exclusive, non-transferable, and revocable license to access and use the platform for its intended purposes.

10.2 Prohibited Activities

Users are prohibited from using the platform to engage in any illegal activities, transmit harmful code, or interfere with the platform’s functionality.

10.3 Monitoring and Enforcement

Jobnur reserves the right to monitor user activity and enforce these terms, including the removal of content or suspension of accounts for violations.

10.4 User Content

Users may post reviews, ratings, and other content on the platform. Jobnur reserves the right to remove or modify content that violates these terms or is deemed inappropriate.

10.5 Intellectual Property

All content on the platform, including text, graphics, logos, and software, is the property of Jobnur or its licensors and is protected by copyright and other intellectual property laws. Users may not use any content from the platform without prior written permission from Jobnur.

10.6 Third-Party Links

The platform may contain links to third-party websites. Jobnur is not responsible for the content or practices of these websites and does not endorse or make any representations about them. Users access third-party websites at their own risk.

10.7 Termination

Jobnur reserves the right to terminate or suspend a user’s account at any time for violations of these terms or for any other reason at Jobnur’s sole discretion. Upon termination, users must cease all use of the platform.

11. Tasker Onboarding and Verification

11.1 Application Process

Prospective Providers (“Taskers”) must complete an application process that includes providing personal information, relevant experience, and other necessary details.

11.2 Background Checks

To ensure the safety and security of all our users and platform, Jobnur requires all Taskers to undergo regular background checks. These checks, conducted by trusted third-party service providers, are a standard part of our onboarding process and are repeated every six months. By using the Jobnur platform, Taskers agree to participate in these background checks, as permitted by applicable U.S. law.

11.3 Verification

Taskers are required to verify their identity and any necessary certifications or licenses. This verification process helps maintain the quality and reliability of services offered on Jobnur.

11.4 Performance Monitoring

Jobnur regularly monitors Tasker performance through user ratings and feedback. Taskers must maintain a high standard of service to continue using the platform.

11.5 Suspension and Termination

Jobnur reserves the right to suspend or terminate Taskers who fail to meet performance standards or violate these terms. Taskers will be notified of any such actions and may have the opportunity to appeal.

12. Consent to Communication

By using Jobnur, users consent to receive communications from us via phone calls, SMS, and email. These communications may include account updates, service-related messages, promotional offers, and other relevant information. Users can opt out of promotional communications by following the instructions provided in the messages.
